Terms of Service

The terms governing use of the SeniorConnex hardware, web app, caregiver portal, and related services.

These Terms of Service ("Terms") govern your access to and use of SeniorConnex hardware, our companion web app and caregiver portal at app.seniorconnex.com, and related services (the "Service") provided by SeniorConnex ("we," "us," or "our"). By using the Service, you agree to these Terms.

1. Who can use the Service

The Service is intended for use by senior-care facilities, their staff, and the families and caregivers of seniors. You must be at least 18 years old and authorized by the senior, the senior's legal representative, or the operating facility to access account data.

2. Accounts and security

You are responsible for keeping your login credentials confidential, for enabling multi-factor authentication where offered, and for the activity that occurs under your account. Notify us immediately if you suspect your account has been compromised.

3. Hardware

SeniorConnex provisions hardware kits, including a Samsung Galaxy Tab A9, a Samsung Galaxy Watch8, a Movesense MD chest strap, and a PontoSense radar sensor, for use with the Service. Hardware is licensed to the facility or family for use with the senior's account, and remains subject to the manufacturer's terms and warranties.

4. Not a medical device. Not a substitute for emergency services.

SeniorConnex is a care-coordination and monitoring service. It is not a regulated medical device, and the alerts, vitals, ECG records, and fall events surfaced through the Service are provided for awareness and care-coordination purposes, not as a substitute for professional medical judgment, in-person clinical care, or emergency services. In a medical emergency, call your local emergency number.

5. Acceptable use

You agree not to:

  • Use the Service to monitor any person without proper authorization.
  • Attempt to circumvent role-gated access, MFA, audit logging, or webhook signing.
  • Reverse engineer, decompile, or extract source code from the apps or portal, except where permitted by law.
  • Use the Service to harass, harm, or surveil any individual.
  • Resell, sublicense, or repackage the Service without a written agreement.

6. Pilot status

Parts of the Service are offered under pilot terms. Pilot features may change, be added, or be removed without prior notice while we tune them with our pilot partners. Pricing for pilot facilities is set in a written agreement.

7. Privacy

Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.

8. Third-party services

The Service depends on third-party providers, Railway, MongoDB Atlas, Firebase Cloud Messaging, Twilio, and hardware partners, each governed by their own terms. We are not responsible for outages or behavior of those providers, but we do our best to design around them.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that every alert will be delivered without delay or failure.

10. Limitation of liability

To the maximum extent permitted by law, SeniorConnex will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the Service. Our total liability for any claim arising under these Terms is limited to the amount you paid us in the twelve months preceding the claim.

11. Termination

We may suspend or terminate access if you violate these Terms or if continued provision of the Service to you would expose us or other users to undue risk. You may terminate your account at any time by writing to us.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date and, if changes are material, notify account holders by email or in the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which SeniorConnex is established, without regard to conflict-of-laws principles.
